  • Sender — The individual or business requesting delivery.
  • Recipient/Receiver — The person receiving the parcel.
  • Courier — Our trained agent responsible for pickup and delivery.
  • Parcel/Item — Any package sent through our Services.
  • Booking — A confirmed request for pickup and delivery made through our platform.

2. Acceptance of Terms

By using our Services, you confirm that:

  1. You have read and understood these Terms.
  2. You agree to comply with them.
  3. You have the legal capacity to enter into a binding agreement.

We may modify these Terms at any time. Updated versions will be posted on our website, and continued use will constitute acceptance of such changes.

3. Eligibility

To use our Services, you must:

  • Be at least 18 years old, or
  • Be a legally registered business duly represented by an authorized person.

4. Service Use and User Responsibilities

You agree to:

  • Use our Services only for lawful purposes.
  • Provide accurate, complete, and truthful information during booking.
  • Ensure your parcel is properly packaged and sealed.
  • Declare the nature, contents, and approximate value of the parcel honestly.
  • Ensure the recipient’s address and contact details are correct.

You may not:

  • Use our Services for illegal, prohibited, or restricted items.
  • Interfere with or attempt to compromise the platform.
  • Provide misleading or fraudulent information.

5. Prohibited Items

Hefty Deliveries does not transport:

  • Dangerous goods (explosives, flammable liquids/gases)
  • Narcotics or illegal substances
  • Contraband or stolen items
  • Currency exceeding legal limits, bonds, or precious stones without prior approval
  • Perishable goods without proper packaging
  • Any items restricted by Kenyan law

We may refuse, stop, or cancel deliveries involving prohibited items.

6. Bookings, Pickup, and Delivery

6.1 Booking confirmation

Your booking is confirmed once payment (where applicable) is processed and you receive a confirmation message.

6.2 Pickup

You must ensure that the pickup location is accessible and that the parcel is ready when the courier arrives.

6.3 Delivery

Our couriers will deliver parcels to the address provided. If the recipient is unavailable, we may:

  • Call or message them
  • Leave the parcel with a designated person where permitted
  • Return the parcel to the sender (additional fees may apply)

Delivery times are estimates and not guaranteed.

7. Fees and Payment

  • All delivery charges are displayed during booking.
  • Fees may vary depending on distance, weight, urgency, or special handling.
  • Payment methods include mobile money, card payments, or cash (where applicable).
  • Failed or reversed payments may result in delayed or canceled deliveries.

8. Proof of Delivery

We may record delivery using one or more of the following:

  • Signature
  • OTP (One-Time Password)
  • Photographic evidence
  • Digital confirmation through our app or system

This documentation serves as final proof of delivery.

9. Limitation of Liability

Hefty Deliveries will take reasonable care in handling parcels. However:

  • We are not liable for delays caused by traffic, weather, road conditions, strikes, or force majeure.
  • Our liability is limited to the declared value of the item, up to the maximum allowed by our internal insurance policy (unless additional coverage is purchased).
  • We are not responsible for:
    • Poor packaging
    • Mis-declared items
    • Recipient refusal
    • Indirect or consequential losses (lost business, emotional distress)

10. Indemnity

You agree to indemnify and hold Hefty Deliveries, its employees, and agents harmless from claims, damages, losses, or expenses arising from:

  • Misuse of the Services
  • Mis-declaration of parcel contents
  • Violation of these Terms
  • Shipment of prohibited items

11. Intellectual Property

All content on our website—including logos, text, graphics, and media—is owned by Hefty Deliveries or its licensors. You may not reproduce or distribute any content without written permission.

12. Privacy

By using our Services, you consent to our collection and processing of personal data as described in our Privacy Policy, including:

  • Contact information
  • Delivery details
  • Payment information
  • Location data during delivery
  • Proof of delivery records

13. Service Suspension and Termination

We may suspend or terminate your access if:

  • You violate these Terms
  • You provide false information
  • You engage in fraudulent or illegal activity
  • Required by law or regulatory authorities

You may terminate your account by contacting us, provided there are no outstanding obligations.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Kenya.
Disputes will be resolved through:

  2. Mediation or alternative dispute resolution
  3. Kenyan courts (final option)
